Men must be very careful when they are dealing with immigration processes especially now when the laws are being motivated by racism. We see that men often receive higher bails, bail bonds are denied more frequently, asylums are denied more frequently, and they last longer in immigration prison.
Whether you are here legally or illegally as an immigrant (non-citizen) man, you have to be more careful because basic situations under civil and criminal laws can have drastic consequences related to immigration processes. Sometimes there are solutions, but they always complicate and extend the immigration processes.
The following situations can have severe consequences with immigration:
- Contacts with the police for fights with your partner, even if they are not physical and even if your partner later removes the complaint it may seriously affect your immigration application. And this lawsuit from your past can also cause you to get a much higher bail in immigration court because they believe you are a danger to society.
- Also, if you have a violation of a restraining order (PFA), you may lose your residence and be deported. Even a phone call that violates the order may result in the cancellation of your process, loss of residence and being placed in deportation proceedings.
- When it’s stated that the husband does not live at home to seek government help and then applies with immigration saying that they live together, this can be considered immigration fraud and the Welfare Department can have the process canceled and placed in deportation proceedings for fraud and the wife may be imprisoned for fraud to the Welfare Department and if she is a resident she may lose her residence as well.
- When married people fill taxes as singles this is considered tax fraud. Many immigration processes ask for family taxes and this type of fraud can cause them to be deported because fraud was committed and in less severe cases can cause immigration to deny their applications for forgiveness because they consider the effect of their departure is less severe because you do not contribute or live with the wife.
It is important to understand that as a man and as an immigrant the laws are applied differently against you and that you have to protect yourself because fair or not fair the consequences for you can be quite severe.
